Terms of Service

1. Agreement to these Terms
These Terms of Service (“Terms”) govern your use of Appial Labs (the “Service”), operated by Appial Labs (“we”, “us”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization, and “you” means that organization. You must be at least 16 years old to use the Service.
2. What the Service does
Appial Labs generates marketing content — strategy, post copy, images, slideshows, scripts and videos — for your app or product using artificial-intelligence models, and can publish approved content to social platforms you connect. The Service is provided “as is”: we do not guarantee any particular marketing outcome, reach, ranking, follower growth, or revenue result.
3. AI-generated content — your responsibility to review
Content produced by AI can be inaccurate, incomplete, or unsuitable for your brand. You are responsible for reviewing content before you publish it or allow it to be published. You must not publish generated content that is unlawful, misleading, infringing, or that violates the rules of the platform it is posted to.
4. Your accounts and connected platforms
You are responsible for your login credentials and for all activity under your account. When you connect a social account (for example X or LinkedIn), you authorize us to store an encrypted access token and to publish the content you approve or schedule to that account on your behalf. You must have the right to post to every account you connect. Social platforms may change or revoke API access at any time; we are not responsible for interruptions caused by connected platforms.
5. Acceptable use
You agree not to:
- use the Service to create or distribute spam, scams, malware, or deceptive content;
- generate content that infringes others’ intellectual-property or publicity rights;
- attempt to bypass credit metering, plan limits, trial restrictions, or security controls;
- create multiple accounts or organizations to farm trial credits;
- resell, scrape, reverse engineer, or programmatically abuse the Service;
- use the Service in violation of any applicable law or third-party platform policy.
We may suspend or terminate accounts that violate this section.
6. Your content and data
The information you provide about your app and brand, and the content the Service generates for you, are yours. To the extent we hold any rights in generated output, we assign them to you upon generation, subject to these Terms and to the terms of the underlying AI providers. You grant us the limited license needed to host, process, and publish your content solely to operate the Service. We do not use your content to train our own models.
7. Our intellectual property
We own the Service — the software, design, pipelines, and trademarks. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing. This does not transfer any ownership of the platform to you.
8. Plans, credits and billing
Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled. You can cancel any time; cancellation takes effect at the end of the current billing period. Each plan includes a monthly credit allowance consumed by generation actions at the rates shown in the product. Trial and promotional credits are one-time grants that we may expire or revoke in cases of abuse. Except where required by law, fees and consumed credits are non-refundable. We may change prices with at least 30 days’ notice before your next renewal.
9. Free trial
New organizations receive a one-time grant of trial credits. One trial per person; we may deny or revoke trials created to circumvent this limit. Trial usage is subject to the same acceptable-use rules as paid usage.
10. Availability
We aim for high availability but do not commit to a specific uptime level, and the Service depends on third-party providers (hosting, AI models, rendering, social platforms) whose outages can affect it. We may modify or discontinue features with reasonable notice where practical.
11. Disclaimer and limitation of liability
To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied. Our total liability for any claims arising from the Service is limited to the amounts you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost data, or damage to your social accounts or brand arising from published content you approved. Nothing in these Terms excludes liability that cannot be excluded by law, including under consumer-protection rules that apply to you.
12. Indemnification
You will indemnify us against third-party claims arising from content you publish through the Service, your violation of these Terms, or your violation of a connected platform’s rules.
13. Termination
You may delete your account at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or abuse. After termination we retain your data for 30 days so you can export it, after which we may delete it from active systems. Sections 6, 7, 11, 12 and 14 survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law rules. Before bringing a formal claim, you agree to contact us and give us 30 days to resolve the issue informally.
15. Changes to these Terms
We may update these Terms. For material changes we will give at least 30 days’ notice by email or in-product notice before the changes take effect. If you continue using the Service after the effective date, the updated Terms apply; if you disagree, cancel before that date.
